IMPORTANT: The provisions of this subsection of our privacy policy apply only to individuals residing in the state of Texas. Residents of other states should refer to our general Privacy Policy or state-specific subsection instead. Texas residents should also review all the other sections of our general Privacy Policy since those sections also apply to Texas residents to the extent they are not contradicted by this Texas-specific subsection.
A. Your Rights Under Texas Law
Effective July 1, 2024, individuals who reside in Texas have specific rights under the Texas Data Privacy and Security Act (the “Act”) and its enabling regulations. Generally, among the rights granted to Texas residents are:
- The right to notice of your rights under the Act;
- Right to know whether we are processing your personal data and to obtain the personal data in a readable format;
- Right to correct inaccuracies in your personal data, taking into account the nature of the data and the purposes for processing the data;
- Right to delete personal data provided by or obtained about you;
- Right to opt out of the processing of personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of a decision made by us concerning you that results in the provision or denial by us of the following: (a) financial and lending services; (b) housing, insurance, or health care services; (c) education enrollment; (d) employment opportunities; (e) criminal justice; or (f) access to basic necessities, such as food and water.
- Right to not face retaliation or discrimination for exercising these rights.
- The right to appeal a denial of your privacy rights request.
B. Our Exemption from the Act
By its own terms, the Act does not apply to a “small business” as defined under the U.S. Small Business Act. See Tex. Bus. & Com. Code § 541.002(a)(3) (2025). We are a small business as defined by the U.S. Small Business Act and therefore qualify for the small-business exemption under the Act. As such, most provisions of the Act, including consumer data rights and controller obligations, do not apply to us. However, we comply with the Act’s requirement not to sell or process sensitive personal data of Texas residents without their consent. This exemption applies only while we meet the U.S. Small Business Act criteria. If our size or activities change, our obligations under the Act may also change. C. Sensitive Personal Data
The Act defines sensitive data as (a) Personal data revealing racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sexual orientation, or citizenship or immigration status; (b) Genetic or biometric data that is processed for the purpose of uniquely identifying an individual; (c) Personal data collected from a known child; or
(d) Precise geolocation data. We do not collect, process, or sell any of these types of data in regard to Texas residents.
