II. Minnesota Residents – Privacy Policy Subsection

IMPORTANT: The provisions of this subsection of our privacy policy apply only to individuals residing in the state of Minnesota. Residents of other states should refer to our general Privacy Policy or state-specific subsection instead. Minnesota residents should also review all the other sections of our general Privacy Policy since those sections also apply to Minnesota residents to the extent they are not contradicted by this Minnesota-specific subsection.
A. Your Rights Under Minnesota Law
Effective July 31, 2025, individuals who reside in Minnesota have specific rights under the Minnesota Consumer Data Privacy Act (the “Act”) and its enabling regulations. Generally, among the rights granted to Minnesota residents are:
- The right to notice of your rights under the Act;
- The right to know or confirm whether we collect or process any of your personal data;
- The right to access personal data we process about you;
- The right to know the express purposes for each type of your personal data we process;
- The right to know the categories of third parties with whom we share your personal data;
- The right to opt-out of processing for targeted advertising, sale, or data profiling using your personal data;
- The right to have your personal data deleted;
- The right to obtain your personal data in a portable and technically feasible format;
- The right to correct any of your erroneous personal data we process; and
- The right to appeal any denial to take action on the above requests within a reasonable time.
B. Our Exemption from the Act
By its own terms, the Act does not apply to a “small business” as defined under the U.S. Small Business Act. See Minn. Stat. § 325M.12, subd. 2(a)(19) (2024). We are a small business as defined by the U.S. Small Business Act and therefore qualify for the small-business exemption under the Act. As such, most provisions of the Act, including consumer data rights and controller obligations, do not apply to us. However, we comply with the Act’s requirement not to sell or process sensitive personal data of Minnesota residents without their consent. This exemption applies only while we meet the U.S. Small Business Act criteria. If our size or activities change, our obligations under the Act may also change. C. Sensitive Personal Data
The Act defines sensitive data as (a) personal data revealing racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sexual orientation, or citizenship or immigration status; (b) genetic or biometric data that is processed for the purpose of uniquely identifying an individual; (c) personal data collected from a known child; or (d) precise geolocation data. We do not collect, process, or sell any of these types of data in regard to Minnesota residents.
